Terms and Conditions
Jennifer Howe Website Design Services:
Any person or company undertaking the services of Jennifer Howe agrees to the terms and conditions as set out.
Jennifer Howe shall not in any circumstances be liable to the client for any losses purported to have been suffered for whatever reason.
Jennifer Howe reserves the right to refuse to handle any material which may be deemed offensive, illegal or controversial and will terminate the hosting service should the need arise.
Jennifer Howe designs bespoke websites, logos etc. in good faith but does not complete formal trademark checks. We accept no liability for any financial or other losses incurred in relation to trademark infringement.
Jennifer Howe reserves the right to reproduce any of its artwork, including approved websites for promotional purposes. The terms and conditions contained herein can be amended at any point as necessary.
Quotations
Any work requested will be quoted for and the quotation is valid for 30 days from the date of issue.
Any additional work requested that is beyond the scope of the original quote, will be charged at a rate of £60 per hour.
Jennifer Howe reserves the right to revise and amend an initial quote to a client if necessary.
Web Design & Build
Upon agreement of the quote and receipt of deposit payment, the build process will begin and an illustration will be created. The illustration will correlate to the quotation and any subsequent additional articles/pages will be deemed to be outside of the original quotation remit and will be quoted for accordingly. Once this has been approved, the website will be built and any changes will be deemed to be an alteration and incur additional charges.
Jennifer Howe cannot take responsibility for any copyright infringements caused by materials submitted or suggested by the client.
Jennifer Howe uses clients’ own material e.g. text, information, images to design websites and is not responsible for these materials.
For larger projects, Jennifer Howe shall set out milestones for the agreed work and attach invoicing points to relevant milestones. The Client should check and agree to these before the work commences. We will ask for agreement that a milestone has been completed (usually by email). This acts as acceptance and sign-off on the work completed to that point. Any desired amendments to work carried out up until an agreed and completed milestone could result in additional costs to the Client. Jennifer Howe will always raise and discuss such occurrences and any cost associated will be agreed with the Client before work continues. Jennifer Howe reserves the right to issue an interim payment at any point should a project be deemed to be taking longer for whatever reason. This will be issued to recover any costs incurred.
Prior to completion of work, Jennifer Howe will test it properly and ensure it meets the agreed specification. This will include testing functionality, cross-browser and cross-device compatibility. Jennifer Howe will give best advice with regards readiness of site launch. Upon completion and acceptance, the website will be considered defect free and complete. If the client does not agree, notification in writing will need to be received within 14 days from the date on which the website has been launched. If a site is incomplete for longer than 3 months and approval/content is not received within that time, Jennifer Howe reserves the right to remove all hosted files and cancel the contract, the initial deposit being non-refundable as it is used to cover all costs incurred up until that point.
Website Errors
Jennifer Howe will support the completed work for a period of 1 month should the Client NOT take out a maintenance agreement. This means that Jennifer Howe will fix any errors reported during this 1 month period. Clients taking out a formal maintenance will be covered for the 12 monthly contract period.
Payment
A non-refundable deposit is required before any work is carried out. A further payment may be required before completion dependent upon the duration of the project – the payment schedule will be detailed on the initial quotation. In all cases, hosting fees and any other costs incurred by Jennifer Howe are required in advance and are non-refundable. Once the brief of the quotation has been met, an invoice for all outstanding monies will be raised. Any alterations at this stage will be completed at the discretion of Jennifer Howe. Payment of a deposit confirms agreement to Jennifer Howe terms and conditions.
Subsequent payment terms, unless stated, are 7 days from date of invoice. Failure to adhere to this will result in late payment and administration charges being applied of £25 initially and then £25 for each and every subsequent 7 day period. The client will also be responsible for any legal costs, agency costs and other expenses which may be incurred in the recovery of overdue amounts.
If accounts are not settled within the agreed timescales, access to the related website may be denied until settlement of the account is made.
All additional work will be quoted for and in some instances, at Jennifer Howe discretion, payment will be required in advance of said work being undertaken. If agreed that payment is after the said work has been completed, Jennifer Howe’ normal payment terms apply. Failure to adhere to these will result in late payment and administration charges being applied of £25 initially and £25 for each and every subsequent 7 day period. The client will also be responsible for any legal costs, agency costs and other expenses which may be incurred in the recovery of overdue amounts. Jennifer Howe also reserves the right to suspend the hosting service until outstanding payments are cleared.
Search Engine Optimisation
Where Jennifer Howe has been asked to provide search optimisation for a client, no guarantee is made of any specific placement or high ranking on search engines.
Hosting
Jennifer Howe will arrange website hosting with our preferred supplier but no guarantees can be made as to the availability or interruption of this service. Jennifer Howe cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service. Jennifer Howe cannot accept liability for any damage and/or disruption caused by any form of hacking, malware, spam or any other malicious attack on any website. Each client owns and therefore has ultimate responsibility for the safety and security of their own website.
If a client has a chosen hosting supplier, Jennifer Howe can assist in the transfer and uploading of all website files but this will incur additional cost.

Fees relating to web hosting or domain names must be paid prior to the expiration date and Jennifer Howe will contact the client at least one month prior to expiry. If the fees remain unpaid at the due date, the service will be cancelled with immediate effect and an additional charge be raised should reinstatement be requested.
Renewals
The client will be contacted in advance of the domain name registration and hosting fees being due. Failure to renew in a timely fashion, may result in termination of service and the domain name may become available to other buyers. Hosting and domain name registration is provided via a minimum 12 month contract.
Cancellation
Jennifer Howe services are renewable annually with 1 month’s notice.
Providing all outstanding monies are up to date, a client may cancel at any given time providing Jennifer Howe with written confirmation 28 days in advance.
Jennifer Howe may at its discretion suspend or terminate the supply of any goods and services if the client fails to make any payment when it is due or otherwise defaults in any of its obligations.
Our terms stated herein are subject to change without notice. This agreement does not affect your statutory rights.
Maintenance
Site maintenance is available and will be a fixed price monthly or annually. If the client engages another party to rebuild or redesign the website Jennifer Howe will no longer be responsible for the maintenance or security of the site.
Website Protection
Jennifer Howe will routinely check website’s of customers who have purchased website protection or other form of website maintenance to make sure that it is using the latest software version and that all components/plug-ins used are of the latest release. A secure copy of the site will also be stored in an alternative location. We will also monitor attempts to hack into the website and block suspicious IP addresses.
Invalidation of Maintenance Agreement
Should a client have or gain access to their website code files and make changes themselves or edit settings in their content management system which then require rectifying, the maintenance contract will become invalid. Any subsequent work to rectify any issues caused and to bring the website back to state it was before would be chargeable.
